М. М. Дурас ЄВРОПЕЙСЬКИЙ ШЛЯХ РОЗВИТКУ В НАПРЯМІ ДОБРОГО МІСЦЕВОГО ВРЯДУВАННЯ: АДАПТАЦІЯ ДО УМОВ УКРАЇНИ
У статті проаналізовано європейський шлях розвитку в напрямі забезпечення доброго місцевого та регіонального врядування на засадах міжнародних документів. Зазначено основні документи, що були ратифіковані та набули чинності для України відповідно до міжнародного (європейського) законодавства. Проведено аналіз умов виникнення таких документів: Європейської хартії місцевого самоврядування, Утрехтської декларації про добре місцеве та регіональне врядування в неспокійний час: проблеми змін, Протоколу № 3 до Європейської рамкової конвенції про транскордонне співробітництво між територіальними общинами або властями стосовно об’єднань єврорегіонального співробітництва (ОЄС).

В статье проанализирован европейский путь развития в направлении обеспечения хорошего местного и регионального управления на основе международных документов. Указаны основные документы, которые были ратифицированы и вступили в силу для Украины в соответствии с международным (европейским) законодательством. Проведен анализ условий возникновения таких документов: Европейской хартии местного самоуправления, Утрехтской декларации о хорошем местном и региональном управлении в неспокойное время: проблемы изменений, Протокола № 3 к Европейской рамочной конвенции о трансграничном сотрудничестве между территориальными общинами или властями относительно объединений еврорегионального сотрудничества (ОЕС).

This article touches upon the European way of development aimed at establishing effective local and regional governance based on international instruments. Furthermore, there is the list of main documents that have been ratified and entered into force for Ukraine according to international (European) legislation. There has been conducted the analysis of conditions for development of the following documents: the European Charter of Local Self-Government, the Declaration of Utrecht on Good Local and Regional Governance in tumultuous times: problems of amendments to the Protocol № 3 to the European Outline Convention on Transfrontier Cooperation between Territorial Communities or Authorities concerning Euro-regional cooperation (ECGs). Unfortunately today Ukraine faces very difficult political, economic and social circumstances that require immediate resolution. In this regard, the agenda of the Parliament of Ukraine comprises the issue of establishing stability in the country and the European way of development. Therefore, the article dwell on the study of European experience and its adaptation to the conditions of Ukraine as well as the determination of the concept of good governance of the country. European way of development in Ukraine has been developing since its independence but at the same time the main European instruments were ratified by Ukraine after the adoption of the Fundamental Law of Ukraine in 1996. This year European Charter of Local Self-Government was signed, the Charter was ratified in 1997 and in 1998 it entered into force in Ukraine. Further steps of formation and development towards establishing good local and regional governance were made in accordance with the international (European) legislation. In 2009 the European Ministers responsible for Local and Regional Governance gathered together during the 16-th session of the Conference, which took place in Utrecht in order to sign a Declaration of Utrecht on Good Local and Regional Governance in tumultuous times: problems of change. But Ukraine only ratified the Protocol № 3 to the European Outline Convention on Transfrontier Cooperation between Territorial Communities or Authorities concerning Euro-regional cooperation (ECG) in 2012, which came into force in 2013. As the result of the study having been conducted in the article they concluded that international documents had the influence of globalization through development of national legislation.
