М.В. Манзя РЕТРОСПЕКТИВНИЙ АНАЛІЗ ФОРМУВАННЯ ТА КОНЦЕПТУАЛЬНІ НАПРЯМИ ПОДАЛЬШОГО РОЗВИТКУ МІСЦЕВОГО САМОВРЯДУВАННЯ В УКРАЇНІ

Стаття присвячена аналізу самоврядних традицій Української держави та історичних витоків системи місцевого самоврядування, окремих аспектів процесу відродження, становлення й конституційного закріплення основ місцевого самоврядування в сучасній Україні та подальшого розвитку місцевого самоврядування, яке є сполучною ланкою між державою й громадянським суспільством, де відображаються інтереси громадянина, громади, місцевих співтовариств і держави на теренах сучасної Української держави.

Статья посвящена анализу исторических истоков системы местного самоуправления и традиций самоуправления Украинского государства, отдельных аспектов процесса возрождения, становления и конституционного закрепления основ местного самоуправления в современной Украине и дальнейшего развития местного самоуправления, которое является связующим звеном между государством и гражданским обществом, где отражаются интересы гражданина, общины, местных сообществ и государства на территории современного Украинского государства.

This article analyzes the historical foundations of local self-government and self-governing traditions of Ukrainian state, some aspects of the revival, the formation and consolidation of the constitutional foundations of local self-government in modern Ukraine and the development of local selfgovernment, which is the link between the state and civil society, and reflect the interests of the citizen, communities, local communities and the State in the territory of modern Ukrainian state. The level of development ofeach country modern management structures reflects the tradition of most people and it is a major cultural heritage. On Ukrainian territory self-governing tradition formed on base of liberty, equality and justice even in preliterate age. In Ukrainian community the whole public development management system was based on such a purely democratic basis for a long time. Effective government local population indicates the country as a country with a highly developed civil society, where the state exists for a person to meet their needs and interests. In Ukraine, local self-government has more than a thousand years of historyin various forms. The new version of the Law on Local Self-Government was adopted March 26, 1992, and took into account the transfer of powers from regional and district councils to the president; the district and regional level of people's deputies were removed from power. The Constitution of Ukraineis fullyaccording to European Charter (along with such fundamental principles as democracy, sovereignty and independence of Ukraine and State Power division). The European Charter of Local Self-Government was adopted under the auspices of the Congress of the Council of Europe and was opened for signature by the Council of Europe’s member states on 15 October 1985. All Council of Europe member states are parties to the Charter. The Article 1 of Ukrainian Constitution captures the principle of recognition and security of local government. So essence of Ukrainian local government is State guaranteed right of communities to solve local importance problems within the limits of the Constitution and laws of Ukraine.
